FOOTSCRAY ART PRIZE 

TERMS AND CONDITIONS  

By entering the Footscray Art Prize (Promotion), you agree to the following conditions: 

1. The promoter is Victoria University (Promoter) (ABN: 83 776 954 731, CRICOS Provider No. 00124K) PO Box 14428, Melbourne, Victoria 8001. 

2. The Promoter is the responsible party in the Footscray Art Prize Group (Partners), which consists of Footscray Community Arts, Maribyrnong City Council, the Rotary Club of Footscray and Victoria University. 

3. All information on 'how to enter' forms part of these terms and conditions. By entering into these terms and conditions you have read, understood and agree to be bound by the terms and conditions. 

4. All entries will be eligible for consideration for the Main prize category (also known as Footscray Art Prize). 

5. Entrants may nominate to enter for two additional sub-categories: 

a. Residency Artist Prize; and  

b. Local Prize (Acquisitive).  

6. You will only be eligible for the prizes in the sub-category or sub-categories you have entered. 

You may enter the Promotion a maximum of two times. Each entry is charged a fee, as detailed below. 

7. Entries will be shortlisted for exhibition based on the following criteria: 

a. Does the Artwork reflect the personal, political, social or artistic intentions articulated by the artist? 

b. Is the Artwork conceptually resolved?  

c. Is the Artwork unique, or contributes to the overall impact of the show? 

8. Entry is open to Australian residents aged 18 and over. 

9. To enter you will need to provide a copy of an original artistic work, which includes but is not limited to; paintings, drawings, photographs, engravings, sculptures and installations (Artwork). The Artwork must not have previously been exhibited for an art prize. The Artwork must not have been created before July 2021 (two years before the exhibition start date).  

10. A non-refundable payment of $35 including GST is applicable for each Artwork entered. 

11. To enter you must complete an online entry form, which must be received by midday, Monday 20 March 2023. The completed entry form must be accompanied by:  

  • a one-page artist biography/CV;  

  • a short description of the Artwork (max 50 words); 

  • a high-resolution JPEG image of the actual Artwork, named with the appropriate naming format (Lastname_Firstname_ArtworkTitle); 

  • video work entries must include a high-resolution video still image, a link to a webpage for the entire video to be viewed and any login details required to access the video; and 

  • appropriate entry fee(s);

Entrants will receive a confirmation email once a correct entry has been submitted. 

Please Note: High quality images and artwork statements will be used for collateral associated with the art prize, including, but not limited to, didactics and exhibition catalogue. 

12. Collaborative Artworks by more than one artist are permitted and will be considered as a single entry. Entrants must nominate one lead contact in the entry form. This person will receive all communication relating to the art prize entry. 

13. The Artwork must not exceed 1.4 metres x 2 metres x 1.4 metres (depth) or 30kg in weight. 

14. The judges (who are to be appointed by the Partners) will select Artworks to display in an exhibition, to be held at Footscray Community Arts (45 Moreland Street, Footscray) from 15 July 2023 to 17 September 2023. Artworks must be available for display for the entire duration of the exhibition. Only Artworks that are chosen, and are submitted for display at the Footscray Community Arts exhibition are eligible to win in any category. 

15. Entrants selected for the exhibition will be contacted between Tuesday 16 May and Friday 19 May 2023. 

16. If chosen for display, the Artworks must arrive at Footscray Community Arts between 10.00am and 04.00pm on Monday 19 June 2023 and Sunday 25 June 2023. Artworks will not be accepted after this date. Artworks must be clearly labelled on the back (or other unobtrusive place) with the artist’s name, title of the Artwork and contact details. 

17.          Entrants must take responsibility for the transport of their Artwork to and from premises for exhibition, including insurance and secure packing for freighted works. Footscray Community Arts will take responsibility to unpack and repack Artwork. 

18. If the entrant’s artwork arrives damaged, the partners are not responsible for any loss or breakage during shipment or delivery. Footscray Community Arts insurance will cover the artwork while on their premises for exhibition. 

19. If the entrant’s artwork is damaged whilst in the care of Footscray Community Arts, the entrant will be paid their agreed wholesale and justified valuation price for the item, provided that a consignment note has been provided as proof of supply. 

20. Artworks can be offered for sale to the public. If you indicate your Artwork is for sale, the price you set will be displayed with the exhibited Artwork. Buyers will arrange purchase through Footscray Community Arts. Artworks sold will incur a commission of 15% plus GST of the sale price. The Promoter and Partners take no responsibility for soliciting the sale of artworks. 

21. Artwork that is sold but not collected by the purchaser within 3 months of the exhibition closing will be returned to the artist. In this instance, ownership of the artwork will transfer back to the artist and the artist will retain the income from the sale (or deposit in the instance that only a deposit was made by the purchaser). 

22. Unsold artworks must be collected from Footscray Community Arts between 10.00am and 04.00pm on Saturday 23 September and Monday 25 September 2023, unless otherwise approved in writing by the Promotor. The Promotor may dispose of uncollected works as they see fit.  

23. All exhibited finalists will be invited to attend The Footscray Art Prize opening on Saturday 15 July 2023 at Footscray Community Arts. 

24. Winners of all categories and sub-categories will be announced at the Footscray Art Prize opening on Saturday 15 July 2023.  

25. Winners may be invited to attend The Footscray Rotary dinner on Saturday 5 Aug 2023. 

26. By submitting an artwork into this competition, you acknowledge that your artwork and name may be made publicly available by the Promoter and Partners and your artwork will be accessible to the public to view at the associated Footscray Art Prize exhibition and online (this may include an online virtual tour of the exhibition). 

MAIN – FOOTSCRAY ART PRIZE 

27. The Main Prize is a non-acquisitive prize. 

28.  There will be one winning Artwork of the Main category (Winner) selected by the judges from the shortlisted exhibited entries. The Winner will receive Prize money of $20,000. 

29. The judges may, with approval from the Partners, declare a second Winner who will receive an equivalent prize.  This is discretionary and based on third party funding availability. 

RESIDENCY ARTIST PRIZE  

30. Entrants to the Main Prize may choose to also nominate to enter the Residency Artist Prize. 

31. There will be one winning Artwork (RA Winner) of the Residency Artist category selected by a Footscray Community Arts representative from the shortlisted exhibited finalists. 

32. The Winner of the Main Prize will be deemed ineligible for the Residency Artist Prize. 

33. The Residency Artist Prize is a non-acquisitive prize. 

34. The Footscray Community Arts representative may, in their sole discretion, declare a second RA Winner who will received an equivalent prize. 

35. The RA Winner will need to be available to participate in a studio residency at Footscray Community Arts for a minimum of two weeks (intensive) and a maximum of three months. The residency must conclude no later than 1 December 2025. The RA Winner will be required to engage with the community either through a showing of their work or a community-engaged event (such as an artist talk or open studio visit). 

36. The residency dates, studio allocation and community-engaged outcome will be negotiated directly between Footscray Community Arts and the RA Winner upon receiving the award. Footscray Community Arts will enter into a residency agreement with the RA Winner. 

37. The Partners will pay an artist fee of $2,000 to the RA Winner. This is to cover materials, and any other costs incurred by the artist as part of the residency and accompanying showing. Note any travel and accommodation costs are not provided as part of the award. 

38. If the RA Winner is unable to participate in the residency for any reason, the RA Winner will not receive nor be credited as the RA Winner of the Residency Artist Prize. If Footscray Community Arts are unable to determine a replacement, the residency will be cancelled. 

LOCAL PRIZE (ACQUISITIVE) MARIBYRNONG CITY COUNCIL ART AND HERITAGE COLLECTION 

39.  Entrants to the Main Prize may choose to also nominate to enter the Local Prize Acquisitive. 

40. Entry in the Local Prize (Acquisitive) is open only to artists who work, live or study in the Local Government Areas of Maribyrnong, Hobsons Bay, Brimbank, Melton, Moonee Valley, and Wyndham.  For local entrants, a statement of connection to Melbourne’s West is required (max 50 words). 

41. Local Prize (Acquisitive) entrants are also eligible to win the Main Prize.  

42. Local Prize (Acquisitive) entrants must self-nominate to considered for the prize and provide suitable proof of their connection to the nominated Local Government Area(s). 

43. By entering, you agree that your Artwork is available for acquisition by Maribyrnong City Council in exchange for the Prize amount of $10,000. 

44. The Local Prize (Acquisitive) will be selected by Maribyrnong City Council, based on its relevance to the themes and acquisition criteria of Maribyrnong City Council’s Art and Heritage Collections Policy.  

45. The winning Artwork(s) of the Local Prize (Acquisitive) (LPA Winner) will be selected by representatives of Maribyrnong City Council from the judges shortlisted Artworks displayed at Footscray Community Arts (45 Moreland Street, Footscray).  If there is not a suitable shortlisted Artwork for acquisition in the shortlisted Artworks, Council may select from all eligible applications submitted. 

46. Maribyrnong City Council may, in their sole discretion, declare a second LPA Winner who will receive an equivalent prize. 

47. Maribyrnong City Council may, decide not to award a Local Prize (Acquisitive) should no entry meet the criteria of the Maribyrnong City Council’s Art and Heritage Collections Policy

48. The LPA Winner’s Artwork will be accessioned into Maribyrnong City Council’s Collection as per the terms of the Art and Heritage Collection Policy

ALL ENTRANTS 

49.          There are three prizes (Prize) to be won: 

  • Main Prize – $20,000 

  • Residency Artist Prize – $2000 (residency fee) 

  • Local Prize (Acquisitive) – $10,000  

50. All prize amounts are exclusive of GST. 

51. Entrants must be individuals and not companies or other entities. Employees and immediate family members of: The Partners; associated agencies and/or companies, that are any way involved in the Promotion, are not valid entrants in the Promotion. Councillors of Maribyrnong City Council and their immediate family members are not valid entrants in the Promotion. Sponsors of the Promotion and their immediate family members are not valid entrants in the Promotion. 

52. Incomplete, illegible, or incorrect entries; entries without entry fees; entries not accompanied by an Artwork; entries received after the closing date; Artworks not suitably framed and ready to hang or otherwise prepared to install; or which breach any law or infringe any third-party rights, including intellectual property rights, will not be eligible to win and will not be exhibited. 

53. The Partners will curate, install and de-install the exhibitions. If you have specific requirements for your Artwork (i.e. electricity) you must specify this in your entry form. 

54. Finalists are responsible for providing equipment to exhibit their Artwork. All Artworks and equipment must comply with OH&S regulations. 

55. All Winners will be selected based on their Artwork having the most artistic merit in their entry category. The winner of the Main Prize will be selected by the judging panel appointed by the Partners.  The winner of the Local Prize (Acquisitive) will be selected by representatives of Maribyrnong City Council, and the winner of the Residency Artist Prize will be selected by representatives of Footscray Community Arts. 

56. The Partners reserve the right to apply content warnings to Artworks without consultation with the entrant. 

57. You warrant that you have created the Artwork and the Artwork is original and does not infringe the copyright, moral rights or other rights of any third party. If an Artwork is based on another work, appropriate approval must be sourced and attached to the entry form. 

58.  You grant the Promoter on submission of your Artwork a royalty free, perpetual, non-exclusive and irrevocable licence to use, reproduce and communicate to the public the Artwork for the purposes of the Promotion, any purpose connected with the Promotion (now and into the future) and for the Partners advertising and marketing purposes. The Partners will respect the author’s moral right of attribution in the Artwork. 

59.  The Winners must ensure that they are available at no additional fee to engage in such reasonable publicity for the promotion and well-being of the competition, as shall be so arranged. 

60.  The Winners will not be entitled to any further remuneration as a result of the Partners subsequent use of the Winner’s Artwork. 

61. The Winners will be announced at the Exhibition Opening on Saturday 15 July 2023, and their name will be published on the Footscray Art Prize (footscrayartprize.com) and Partners’ websites. 

62.  This is game of skill. Chance plays no part in determining the winner.  

63. In all matters relating to the Promotion, all decisions will be final and cannot be contested. No correspondence or discussions will be entered into. 

64. If for any reason any aspect of this competition is not capable of running as planned, including due to any cause beyond the control of the Partners, the Partners may in their sole discretion cancel, terminate, modify or suspend the competition and its associated exhibitions. If terminated, all entry fees paid will be refunded in full. 

65. Prize winners who are professional artists with the provision of artwork as part of their business enterprise, will need to provide a tax invoice and ABN. Prize winners who have entered the competition in the furtherance of an activity done as a private recreational pursuit or hobby will need to provide a completed Statement by a Supplier as a reason for not quoting their ABN. 

66. The Promoter and Partners and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).  Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
