YOUNG ARTISTS PRIZE

TERMS AND CONDITIONS

By entering the Footscray Art Prize – Young Artists (Promotion), you agree to the following conditions:

  1. The promoter is Victoria University (Promoter) (ABN: 83 776 954 731, CRICOS Provider No. 00124K) PO Box 14428, Melbourne, Victoria 8001.

  2. The Promoter is the responsible party in the Footscray Art Prize Group (Partners), which consists of Footscray Community Arts , Maribyrnong City Council, the Rotary Club of Footscray and Victoria University.

  3. All information on 'how to enter' forms part of these terms and conditions. By entering into these terms and conditions you warrant that you have read, understood and agree to be bound by the terms and conditions.

  4. Entry is open to Australian residents aged 18 and under who live or attend school in the Western Region Local Government Areas of Brimbank, Hobsons Bay, Maribyrnong, Melton, Moonee Valley, Wyndham and Hume.

  5. There are two entry categories, which are based on the entrant’s school level as of 1 February 2022:

    - Primary school; and
    - Secondary school

  6. To enter you will need to provide a photograph of an original artistic work, which includes but is not limited to; paintings, drawings, photographs, engravings, sculptures and installations (Artwork).

  7. To enter you must select the entry category, age and eligibility details and complete an online entry form, which must be received by Midday, Monday 20 March 2023. The completed entry form must be accompanied by:

    - a short description of the Artwork (max 50 words); 

    - a JPEG image of the actual Artwork named with the appropriate naming format (LastName_FirstName_ArtworkTitle); and
    - a consent form signed by a parent or guardian if the entrant is under 16 years of age.

Entrants will receive a confirmation email once a correct entry has been submitted.

8. The primary school category Artwork must not exceed A3 (30cm x 42cm) or 1.5kg in weight.

9. The secondary school category Artwork must not exceed A2 (42cm x 60cm) or 5kg in weight.

10. All Artworks will be displayed in an exhibition to be held at Footscray Community Arts (45 Moreland Street Footscray) from 15 July 2023 – 6 August 2023. Artworks must be available for display for the entire duration of the exhibition. Only Artworks that are exhibited are eligible to win.

11. The Artworks must arrive at Footscray Community Arts between 10.00am and 04.00pm between Tuesday 27 June 2023 and Saturday 1 July 2023. Artworks will not be accepted outside of these dates.

12. Artworks must be clearly labelled on the back (or other unobtrusive place) with the entrant’s name, title of the Artwork, contact details and installation instructions. Artworks that are not labelled correctly may not be included in the exhibition. No responsibility will be taken for lost or misplaced Artwork that was not clearly labelled.

13. Entrants must take responsibility for the transport of their Artwork to and from Footscray Community Arts.

14. Artworks must be collected from Footscray Community Arts between 2pm and 06.00pm between Tues 8 August 2023 and Wed 9 August 2023, unless otherwise approved in writing by the Promoter. Any uncollected Artworks will become property of the Promoter.

15. All care will be taken; however, the Promoter will not be responsible for any loss or damage caused to any Artwork, howsoever caused.

16. There will be two winning Artworks selected from the valid entries (Winners). There will be one Winner in each category.

17. Winners will be announced at the exhibition opening on Friday 15 July 2023, and their name will be published on the Footscray Art Prize (footscrayartprize.com), and Partner’s websites.

18. You may enter the Promotion only once.

19. There are two prizes (Prize) to be won:

-       Primary school category: Prize – $500
-       Secondary school category: Prize – $500

20. Entrants must be individuals and not companies or other entities. Employees and immediate family members of: The Partners, associated agencies and/or companies, that are any way involved in the Promotion, are not valid entrants in the Promotion. Councillors of the Maribyrnong City Council and their immediate family members are not valid entrants in the Promotion.

21. Incomplete, illegible or incorrect entries; entries not accompanied by an Artwork; entries not accompanied by a consent form (if required); entries received after the closing date; Artworks not suitably framed and ready to hang or otherwise prepared to install; or which breach any law or infringe any third-party rights, including intellectual property rights, will not be eligible to win.

22. Footscray Community Arts will curate, install and deinstall the exhibitions. If you have specific requirements for your Artwork (i.e. electricity) you must specify this in your entry form.

23. Finalists are responsible for providing equipment to exhibit their Artwork. All Artworks and equipment musty comply with OH&S regulations.

24. The Winners will be selected based on their Artwork having the most artistic merit in their entry category, as selected by the judging panel.  

25. You warrant that you have created the Artwork and the Artwork is original and does not infringe the copyright, moral rights or other rights of any third party. If an Artwork is based on other work, appropriate approval must be sourced and attached to the entry form.

26. You grant to the Promoter on submission of your Artwork a royalty free, perpetual, non-exclusive and irrevocable licence to use, reproduce and communicate to the public the Artwork for the purposes of the Promotion, any purpose connected with the Promotion (now and into the future) and for the Promoter’s advertising and marketing purposes. The Promoter will respect the author’s moral right of attribution in the Artwork.

27. If you are under 16, the Promoter will not attribute the Artwork to you, or use your name or photograph in any way, unless the Promoter has obtained consent to do so from your parent or legal guardian.

28. The Winners will not be entitled to any further remuneration as a result of the Promoter’s subsequent use of the Winner’s Artwork.

29. This is a game of skill. Chance plays no part in determining the Winner.

30. In all matters relating to the Promotion, all decisions will be final and cannot be contested. No correspondence or discussions will be entered into.

31. If for any reason any aspect of this competition is not capable of running as planned, due to any cause beyond the control of the Promoter, the Promoter may in their sole discretion cancel, terminate, modify or suspend the competition and its associated exhibitions.

32. Prize Winners who are professional artists and the provision of artwork is part of their business enterprise then they will need to provide the University with a tax invoice and ABN. Prize Winners who have entered the competition in the furtherance of an activity done as a private recreational pursuit or hobby they will need to provide the Promoter with a completed Statement by a Supplier as a reason for not quoting and ABN.
